Utracon in India
Utracon Corporation Pte Ltd (“UCPL”) and Utracon Structural Systems Private Limited (“USSI”), now known as Ucon PT Structural Systems Private Limited (“Ucon PT”), entered into a license agreement (“License”) dated 22 March 2012, whereby UCPL permitted USSI to use UCPL’s certain intellectual property rights for a period of ten (10) years effective from 01 April 2011.
The trademark “UTRACON” and its logo constitute registered intellectual property of UCPL under Class 37 bearing Trademark No. 2379606 issued by the Trade Marks Registry, Government in India under Trade Marks Act, 1999.
Despite the license had expired on 31 March 2021, to the date of this notice, although the name Ucon PT and its logo are placed on their official website (www.utraconindia.com) and social media such as Facebook and LinkedIn, the website domain still includes the trademark “UTRACON” and several web pages still contain the trademark “UTRACON” and its logo.
Therefore, it is notified in the public interest:
- Ucon PT is no longer a licensee of Utracon Group. Thus, Ucon PT is not authorised to use the trademark “UTRACON” since 01 April 2021,
- Ucon PT is not authorised to use and/or supply products of Utracon and Dywidag,
- UCPL has no working relationship whatsoever with Ucon PT, and
- UCPL assumes no liability and responsibility for any misrepresentations that may be made by Ucon PT through the unlawful use of the trademark “UTRACON”.
The only company that is authorised to represent Utracon (UCPL) in India is Utracon Engineering Services Private Limited (“UESI”).
